Types of Divorce

  • Dissolution of marriage- this may be possible if both parties sign the Petition for Dissolution of Marriage and a Separation Agreement that settles property and debt division, alimony, and child support/custody of any minor children. 
  • Divorce- One spouse files a lawsuit against the other, asking the court to decide all matters pertaining to the marriage.

Ohio Divorce Requirements:

In the state of Ohio, the party filing the Complaint for Divorce must have lived in the state of Ohio for at least six months and in the county they will be filing for the divorce for at least ninety days.

Grounds for Divorce:

  • No-fault divorce- in Ohio, to qualify for a no-fault divorce, the parties must state in their claim that “the parties are incompatible,” or “the parties have been living separate and apart without cohabitation for 1 year.” This is the primary ground Ohio uses, as there is no need to prove any wrongdoing from either party.
  • Fault-based divorce- to qualify for a fault based divorce, one party must prove one of the following:
    • Bigamy;
    • Willful absence of the other party for 1 year;
    • Adultery;
    • Extreme cruelty;
    • Fraudulent contract;
    • Gross neglect of duty;
    • Habitual drunkenness;
    • Imprisonment in a state or federal prison at the time of filing.
